Medicare Benefits for the Injured Person

What is important to know, as it relates to legal claims, is that if you receive Medicare benefits for injuries sustained in a third-party action and then make a monetary recovery in that action, Medicare has a statutory right to be reimbursed. There are appeal rights if you believe, for example, that Medicare is trying to get reimbursed for payment of treatment unrelated to the claim, but the fact remains that you are legally required to deal with, and repay, Medicare, 42 U.S.C. s. 1395y(b)(2)(A).
