MedPay Benefits Here In Massachusetts

Imagine a scenario where you have paid an additional premium for MedPay benefits as part of your automobile insurance coverage, then get into a car accident and find out that your MedPay benefits may not be available to you since you have health insurance coverage also!

This has been the dispute here in Massachusetts until recently. The Supreme Judicial Court has now ruled that an injured person's MedPay benefits are available to her even though her medical expenses were covered by a separate health insurance policy. The name of the case is Golchin v. Liberty Mutual Insurance Company and it does provide additional protections to an injured party who made the financial commitment to obtain both MedPay and health insurance coverages.
