Medicare Benefits for the Injured Person

I could not begin to fully explain all the intricacies of the Medicare Plan;  however, you should be aware that it is available to all US citizens over the age of 65 or who have certain disabilities;  in summary, it will provide you with certain health insurance coverages.

What is important to know, as it relates to legal claims, is that if you receive Medicare benefits for injuries sustained in a third-party action and then make a monetary recovery in that action, Medicare has a statutory right to be reimbursed.  This will require you [or your attorney] to contact the Medicare Secondary Payer Recovery office in Oklahoma and obtain from them a conditional payment amount.  There are appeal rights if you believe, for example, that Medicare is trying to get reimbursed for payment of treatment unrelated to the claim, but the fact remains that you are legally required to deal with, and repay, Medicare, 42 U.S.C. s. 1395y(b)(2)(A).
