A recent case caught my eye- a customer went to a gas station where he was assaulted, set on fire and eventually died. As it turns out, this gas station was in a recognized high-crime area where drug dealers were known to congregate. The claim of inadequate security was alleged against the station ower- through investigation and discovery, it was determined that the exterior cameras were broken, the lighting was poor and a former employee was prepared to testify that he sometimes called the police to escort him to his car. All these factors- and others- played into the decision by the owner’s insurer to settle this case for a very large amount of money.
Once again, the lesson is that a case is limited only by the specific facts available and the creativity and perseverence of the attorneys developing the case.
